General Terms and Conditions

Gift Cards

Gift cards can be purchased in store and online for Homesense and TK Maxx.

Terms and Conditions of use

Homesense gift cards can be used in Homesense and TK Maxx stores. A gift card can only be used in the country in which it was purchased.
There are two types of gift card. An open value gift card remains open and further amounts can be added to it at any time up to a maximum value of £999.99. A specified value gift card has a fixed amount when purchased and further amounts cannot be added. Ask in store if you are not sure which gift card you have.
Gift cards can only be used for the purchase of merchandise. No more than five gift cards can be used in one transaction. Gift cards purchased in store cannot be returned or exchanged for cash.
The holder of the gift card is responsible for its security. Lost, stolen or damaged gift cards will not be replaced.
Purchases made with a gift card will be deducted from the balance until it reaches zero. No change will be given, so the remaining balance will stay on the gift card and can be spent on future purchases. If the purchase price exceeds the amount available to spend on the gift card, the remaining balance can be settled via another accepted payment method. You can check your balance in store or online at https://www.homesense.com/
The cost of anything you buy with a gift card and return to store in accordance with the TK Maxx and Homesense Returns Policy will be refunded to a gift card. This does not affect your statutory rights. See full details of our Returns Policy by clicking here.
The funds on your gift card are not covered by the Financial Services Compensation scheme.

All other terms will remain in full force and effect. Waiver

If you breach these Terms and Conditions and we take no action, TJX UK will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing Law and Jurisdiction

These Terms and Conditions are to be construed in accordance with the laws of England and, in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Entire Agreement

The above Terms and Conditions, the Returns Policy and any emails regarding the services TJX UK provides constitute the entire agreement of the parties (TJX UK and the customer) and supersede any and all preceding and contemporaneous agreements between you and TJX UK. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by a Director of TJX UK.

How do I return something I bought in store?

Merchandise must be unused and in its original condition including packaging and labelling

Pierced jewellery and gift cards are excluded from our returns policy

If you paid by credit or debit card any refund will be to the original card you used to purchase

If you paid by gift card, the refund will go on to another gift card

Gift receipts can be used to return an item for exchange or gift card but not refund

Homesense items cannot be returned to TKMaxx stores and must be returned to Homesense stores only

This does not affect your statutory rights.

Sometimes we have to refuse a refund or exchange usually because the item is outside the return period or is not in its original condition. Make sure you follow all the above to avoid any embarrassment.

If a Winner does not do so, the Promoter reserves the right to not reissue the Prize or limit its value at its sole discretion.
Provided no objection is received from the Winners, a Winners list containing the surname and county of residence of the Winners will be made available by the Promoter 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be available by sending a request via email to customerservice@tjxeurope.com. The Winners can object to their details being published by emailing customerservice@tjxeurope.com or by calling +44 1923 473561. Without prejudice, the Promoter will provide Winner information to the Advertising Standards Authority when requested by them.
The Promoter may request that the Winners participate in publicity arising from the Promotion. Participation is at the Winner’s discretion and is not a condition of Prize Acceptance.
The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
1. Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
2. Disqualify entries that are not made directly by the individual entering the Promotion.
3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
5. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
6. Disqualify entrants who tamper with the entry process.
7. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
8. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason a Prize and/or any element of a Prize is not available, the Promoter reserves the right, at its sole discretion to substitute that Prize or element of the Prize for another of equal or greater value.
No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the websites listed under Clause 4.
The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS15214) or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. From time to time, Homesense, a trading name of TJX UK, ("TJX") may contact users on social media platforms, such as Facebook, X (formerly Twitter), Pinterest, Instagram, and others, (each a "Social Media Platform") about using their content. For example, if a user posts a photograph or other content of an item they purchased from TJX on a Social Media Platform, TJX may ask in the comments to that photograph or via direct messaging or using an email address provided by user if the user agrees to allow TJX to use the photograph in accordance and agreement with these terms and Conditions (the "Terms"). The photograph or other content of the user (including, but not limited to photograph captions and user's Social Media Platform handle) is referred to as "User Content" in these Terms. By agreeing to allow TJX to use your User Content, you are agreeing to these Terms and to TJX's use of your User Content in accordance with these Terms.

LICENCE GRANT

You hereby grant TJX, its affiliates, subsidiaries, successors and assigns, a non-exclusive licence (but not the obligation) to reproduce, publicly perform, stream, exploit and otherwise use your User Content as well as your username, voice, likeness, image, and other identifiable characteristics along with your username and any statements made by or attributed to you relating to your User Content or TJX ("Image Rights") throughout the universe to promote TJX and its products and services in all media and formats whether now or later known or developed, including on any Social Media Platform, without further notice to, consent by, or payment to you. Without in any way limiting the foregoing, TJX shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, make derivative works of, or alter the User Content for any purpose that TJX deems necessary or desirable, and you irrevocably waive in favour of TJX and our assignees and licensees any and all moral and/or performers rights arising under the Copyright, Designs and Patents Act 1988 or similar rights under the laws of any jurisdiction you may have therein. TJX shall have the right to freely assign, transfer or otherwise deal in any manner with any or all of its rights under these Terms, in whole or in part.

Our rights to use the User Content and/or Image Rights last indefinitely unless and until they are cancelled by you, which you can do at any time by contacting us at homesense_marketing@tjxeurope.com.

REPRESENTATIONS AND WARRANTIES

You promise to us as follows: (i) you are at least eighteen (18) years of age and not a minor; (ii) the User Content is your own original work or, if the User Content or any component thereof is owned in whole or part by anyone other than the user (for example, if the User Content was created by a photographer other than the user), you shall, prior to agreeing to these Terms, obtain consent from the owner of such materials for the User Content to be used by TJX; (iii) you have obtained consent from all persons whose image, username, likeness, voice or other identifiable characteristics are included in the User Content; (iv) the User Content does not contain any computer virus (as applicable), is otherwise uncorrupted, is wholly original with you, and as of the date of submission to TJX, is not the subject of any actual or threatened litigation or claim; (v) the User Content does not and will not violate or infringe upon the intellectual property rights or other rights of any third party; and (vi) the User Content does not and will not violate any applicable laws, and is not and will not be defamatory or libelous.

LIABILITY

You agree that TJX shall not be responsible or liable for any losses, liabilities, costs, taxes, damages, or injuries of any kind arising out of or in connection with TJX and/or its affiliates using the User Content and/or Image Rights in accordance with these Terms. Nothing in these Terms shall limit TJX's liability for death or personal injury arising from negligence, nor for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor for any other liability which cannot be excluded or limited by applicable law. You are liable to us and indemnify us against any actions, loss and damage arising out of any claims by third parties in connection with the User Content and/or Image Rights, including claims for breach of intellectual property, data protection, privacy, image, performance, or publicity rights. This means that you will be responsible for any loss or damage we suffer as a result of your breach of these rights and/or the promises made by you in these Terms.

DATA PROTECTION

The User Content and/or Image Rights may contain information about you or identifiable individuals which constitutes personal data under applicable laws. By agreeing to these Terms, you agree to the processing of such personal data by us for the purposes set out in these Terms. Where any personal data relating to any other person appears in the User Content and/or Image Rights, you promise that you have also obtained their consent for us to process such personal data. We will process personal data included in the User Content and/or Image Rights or otherwise provided to us in connection with our use of the Content in accordance with all applicable data protection laws and our privacy policy, which is available here.

LAW

In the United Kingdom, these Terms are governed by English law and wherever you live you can bring claims against TJX in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against TJX in the courts of the country you live in.

TJX can claim against you in the courts of the country you live in. In the Republic of Ireland, these Terms are governed by Irish law and subject to the exclusive jurisdiction of the Irish courts.
